LCDGA Membership Liability Waiver
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT
BY AGREEING TO THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

In consideration for being granted membership in, and for being allowed to participate in any or all events and related activities of the Lake Cowichan Disc Golf Association (LCDGA), I/we hereby warrant and agree that:

  1. I am familiar with and accept that there is always a risk of injury, illness, or death resulting from participation in any organized recreational activity, particularly those involving activities offered as part of the programs and events of LCDGA; and

  2. I have satisfied myself, and believe, that I am physically, emotionally, and mentally able to participate in these programs and events, and that any equipment I use is appropriate for such activities; and

  3. I understand that all applicable rules for participation, INCLUDING HEALTH REGULATIONS AND RESTRICTIONS AS DICTATED BY BRITISH COLUMBIA HEALTH AUTHORITIES, must be followed, and that the sole responsibility for my personal safety remains with me at all times; and

  4. I will immediately remove myself from participation and notify the nearest official or organizer if at any time I observe any unusual hazard, unsafe condition, or if I feel unwell or otherwise unfit (physically, emotionally, or mentally), or feel that I am unable to safely continue participation in any event or related activity; and

  5. If I am over 18 years of age, I agree to allow LCDGA to photograph and/or video me during LCDGA-sanctioned events. I also consent to LCDGA’s use of such photographs and/or videos on its official website and social media channels for promotional purposes.

I UNDERSTAND AND AGREE, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, that by digitally agreeing to this waiver I am providing:

  1. AN UNQUALIFIED ASSUMPTION BY ME OF ALL RISKS associated with my participation in any and all events and activities of LCDGA, even if arising from the negligence or gross negligence — including negligent rescue operations — of LCDGA, any event organizer, venue, and any persons associated with such events, or in transport to/from such events; and

  2. A FULL AND FINAL RELEASE AND WAIVER OF LIABILITY AND ALL CLAIMS that I may now or in the future have against LCDGA, its sponsors, partners, directors, officers, employees, volunteers, coaches, leaders, contractors, agents, representatives, and any others participating in any capacity (herein collectively referred to as “the Releasees”), from any and all liability for loss, damage, injury, or expense, including from negligence, gross negligence, breach of contract, or breach of any statutory or other duty of care (including duties under the Occupiers Liability Act of British Columbia); and

  3. AN AGREEMENT NOT TO SUE THE RELEASEES for any loss, injury, costs, or damages of any kind, whether direct or indirect, resulting from my participation in any aspect of LCDGA events and activities; and

  4. AN AGREEMENT TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from any litigation expense, legal fees, liability, damage, award, or cost of any kind they may incur due to any claim brought against them by or on behalf of me, my estate, or any third party as a result of my participation, regardless of cause; and

  5. AN AGREEMENT that this document shall be governed by the laws of the Province of British Columbia and that any legal proceedings shall be brought exclusively in the courts of British Columbia; and

  6. CONSENT to the sharing of the information in this waiver with LCDGA, relevant insurance providers, and other parties as required under LCDGA's Privacy Policy for the purpose of administering programs, insurance coverage, and association operations.

I HAVE READ AND UNDERSTAND THIS AGREEMENT and acknowledge that by agreeing to it, I am waiving certain substantial legal rights that I, my heirs, executors, administrators, and assigns may have against the Releasees, either individually or collectively.

I AGREE TO THIS WAIVER VOLUNTARILY AND WITHOUT INDUCEMENT as of the date of my registration or participation in LCDGA activities.
